If you continue to browse and use this website, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern RotoSpa’s relationship with you in relation to this website. If you disagree with any part of these terms and conditions, please do not use our website.

The term ‘RotoSpa’ or ‘us’ or ‘we’ refers to the owner of the website whose registered office is 35 Boldmere Road, Boldmere, Sutton Coldfield, Birmingham, B73 5UY. The term ‘you’ refers to the user or viewer of our website.

The use of this website is subject to the following terms of use:

RotoSpa lifetime warranty terms & conditions retail customers only

Introduction 

Our customer service representatives are not authorized to modify any provision of this Agreement, either verbally or in writing.

User eligibility & registration

You must be 18 years of age or over to purchase the RotoSpa Lifetime Warranty. The RotoSpa Lifetime Warranty is provided to individuals for their personal, non-commercial use only. Companies and other groups may register for the RotoSpa Commercial Service account. Any notices RotoSpa delivers to you may be made by email to the last email address provided by you. You agree to provide and maintain accurate, current, and complete information, including your contact information for notices and other communications from us.

Subscription terms

Payment will be charged to your chosen payment method provided at confirmation of purchase.  Your subscription will automatically renew, to cancel auto renewal, navigate to www.rotospa.co.uk/cancel/autorenewal and click “end auto renewal.” 

Interest payments and charges

Your Instalment Plan is not a credit agreement regulated by the consumer Credit Act 1974. You will pay no interest, nor will you incur any additional charges for using the Instalment Plan. The amount you pay each month will be the agreed discount fee of the RotoSpa Lifetime Warranty divided by 12 (12 x instalments).  On the anniversary of each 11-month period, we will notify you of any price increases for the following years subscription. The lifetime Warranty will continue for a maximum of ten (10) years from when the subscription was first taken out. If auto renewal is cancelled during this time by the customer, you will no longer be supported by the lifetime warranty.

Returned payments and cancellation Fees

If you cancel the plan, other than during the cooling off period, before all payments are made in each 12-month period, you become liable for the remaining period at the “Total Value” price.

Failure to pay instalments

If you fail to keep up your instalment, you will be contacted by our customer service team and asked if you wish to continue with your plan. If the outstanding balance is not settled within 14 days of the payment date for that month, then your lifetime warranty may be made void.

Cooling off period

You have a statutory right to withdraw within 14 days of signing up to the RotoSpa Service. However, you acknowledge that if you utilise the services of our engineers within that period you lose your right to withdraw from the RotoSpa Service.

Use & sharing of your information

You acknowledge that RotoSpa is the data controller responsible for the processing of your personal data to provide you with the RotoSpa Service. For more information about our collection, use, and sharing of your information please refer to our Privacy Policy, www.rotospa.co.uk/privacy-policy.

Language

All documents and all communications shall be subject to English Law. Nothing in these terms and conditions will reduce or affect your statutory rights. For further information about your Statutory Rights you can contact your local Authority Trading Standards Department or Citizens Advice Bureau.

Force majeure

We will not be liable for any delay or failure to carry out work if we are prevented from doing so in circumstances beyond our reasonable control including, without limitation, legal restrictions which prevent us attending, industrial dispute. Or severe weather conditions. In such circumstances we shall be entitled to a reasonable extension of time for the performance of attendance.

 Shell – lifetime

Water loss arising from structural failure, the shell surface finish against manufacturing defects in materials or processing; including cracks, blisters & de-lamination are all covered. This cover does not extend to damage caused by improper care, negligence, normal wear & tear or the fading colours and materials, whether caused by the natural effects of UV light over an extended period & or the misuse of chemicals.

Electrical – 10 years

Factory installed electric components are covered against malfunction arising from defects in materials or poor-quality fitting. They are pump, heater, control system, heater tube, air blower & LED Light.

Plumbing – 10 years

Factory installed plumbing components are covered from defective materials & poor-quality fitting. This includes leaks from all internal & external fittings & bonded joints.

Non-electrical & non-plumbing components – 10 years

Factory installed components are covered against malfunction arising from defects in material or poor quality of manufacture. They are topside control unit, diverter cap, air control cap, cover clips, jets, headrest & drinks tray. Fading, discolouration, & scratches are all considered normal wear & tear. Splits & rips are considered misuse & void any warranty claim. 

Conditions of warranty

The warranty Includes parts, travel, & onsite labour necessary for repair. This warranty is issued on a rolling yearly basis and, is subject to an annual service carried out by an authorised RotoSpa Engineer. Any spa that does not have an annual service within 30 days from each annual anniversary of purchase, will no longer be supported by this warranty. Failure to meet each monthly payment may void your warranty &, will be subject to an administration fee of £75. This extended warranty will continue until the anniversary of 10 years from when the plan was taken out or, until auto renewal is cancelled by the customer whichever is the sooner. The warranty on the shell is covered for a lifetime under RotoSpa standard warranty package. All parts must be purchased from RotoSpa & installed by RotoSpa or, one of its authorised panel of engineers. Failing which, all spa warranty including shell warranty will be void.  The warranty is given only to the person originally taking out the plan & at the address provided at inception. Any movement of the Spa from its original position will no longer be supported by the warranty unless carried out by an authorised RotoSpa engineer. Furthermore, this warranty does not include costs incurred by non-authorised engineer. Customers must gain written consent from RotoSpa Limited before instructing any engineer not authorised by RotoSpa Limited. In all cases RotoSpa Limited has the sole responsibility for determining the cause & nature of a fault. RotoSpa Limited’s determination is final. RotoSpa Limited reserve the right to provide a replacement spa of equivalent value if we deem it to be necessary. In such a circumstance, the customer shall be responsible for the cost of transportation, moving & installing the new spa into position. Only Spas manufactured by RotoSpa Limited & supplied directly or via its authorised dealers to residential retail customers based in the UK Mainland are covered by this warranty. Any errors relating to air locks are expressly excluded from the warranty.  

Execution

The customer must report faults within 7 days to RotoSpa. A RotoSpa Limited representative will diagnose any reported fault over the telephone & may suggest several possible solutions for the customer to attempt. If no solution is found RotoSpa Limited will then send out an engineer to diagnose the problem. The customer will be solely responsible for the cost of any parts, travel @2p per mile and the engineer’s labour charge of £72 per hour should the fault not be determined as a warrantied failure. The spa and all its equipment must be fully accessible, having two feet clear around all sides. This space enables any work required to be safe and efficient. RotoSpa Limited reserves the right to make additional charges to cover extra time spent undertaking any works due to restricted access.

Exclusions
All warranties hereunder are void if the spa has been subject to chemical misuse or chemical imbalances, water quality from supply (hard/soft water) alterations or modifications not authorised by RotoSpa Limited. In compliance with the terms & conditions of your warranty, no chemicals & or other products should be added to your bathing water unless supplied by RotoSpa Limited.  This warranty will become void if any of the following are evident. Unauthorised attempts to repair the Spa, incorrect use of the Spa including but not limited to running the Spa dry or filling the Spa incorrectly, leaving the spa uncovered or exposed to extreme seasonal weather when empty, electrical installation by a non-qualified electrician, ice in the spa, incorrect winter preparation, used in commercial settings, hire or reward, customised or modified in any way, abuse. The warranty will also become void if any of the following are evident. Chemical damage including but is not limited to limescale deposits on the Spa shell or any of its components, incorrect chemical levels, and incorrect use of chemicals. Please note that chemical use is the sole responsibility of the customer.  Shell and component defects resulting from not using the cover when the Spa is not in use. Any defects resulting from not maintaining or correctly operating the Spa: unless carrying out a proper shutdown (turning the Spa off and leaving it for a prolonged period while full). RotoSpa has the right to void any warranty given if the goods are used for anything other than normal purposes. Warranty claims are and will only be up to the value the RotoSpa was purchased at. (Pricing excludes price paid for delivery and any optional extras)

Chemicals

Due to variations in the standard of chemicals available in the marketplace & the fact that we are unable to determine the quality of non RotoSpa products, it is a condition of all our warranties that only RotoSpa products should be used in our Spas. This condition serves to protect the safety of the Spa as well as its users. The use of unauthorised chemicals in your Spa will result in your warranty being void. Headrests, covers & any other components shall not be covered by warranty in the event of chemical misuse or overdosing chemicals. This condition includes but is not limited to chemicals, fragrances, and cleaning products.

Disclaimer
RotoSpa Limited will not be liable for loss of use of the spa, or any incidental expenses incurred because of the repair or replacement of the spa. This includes but is not limited to permanent decking or surroundings, flooring, any other fixtures, chemical loss, water loss or filter loss.  In the event RotoSpa Limited considers it necessary to remove the spa to a place of repair or that the Spa or shell be replaced, any costs of the spa removal & replacement landscaping, decking, fencing, &/or structural removal, alteration &/or replacement or other costs of providing access to the spa will be the customer responsibility. Any repairs or replacement parts fitted or supplied during the warranty period shall assume as its warranty only the remaining portion of the warranty on the original product. Strictly manufacturing faults and defects only. Travel and labour are not included, and these costs are to be met by the customer.

Changes to terms and conditions

We may from time to time change these terms & conditions without giving notice, but we will use our reasonable endeavours to inform you of any change as soon as is reasonably possible.

Law and jurisdiction

These terms & conditions and the relationship between RotoSpa Limited and you shall be governed and construed in accordance with the law of England & Wales.
